CBD Flower, Hash and Resin in Malta: The 2026 Guide
Is CBD flower, hash or resin legal in Malta? The 0.2% rule, the HHC ban, how to check a lab report, and THC-free alternatives delivered free.

On this page
Short answer: CBD flower, hash and resin can be legal in Malta, but only if they are made from non-psychoactive cannabinoids and contain no more than 0.2% psychoactive cannabinoids such as THC. Anything sprayed with HHC or similar semi-synthetics is banned. Dr. Hemp Me does not sell flower, hash, resin or pre-rolls: we make THC-free CBD oils, gummies and capsules, each with a lab report.
A lot of people in Malta search for CBD flower and CBD hash. This guide explains what the law says, how to tell a legal product from an illegal one, and why we chose to make oils instead. It is a plain-English summary, not legal advice.
Is CBD flower legal in Malta?
Since 16 May 2025, Maltese law (the Dangerous Drugs Ordinance, Cap. 101, as amended by Act XII of 2025) has a new definition of cannabis. It excludes inflorescence, leaves, extracts and products derived from non-psychoactive cannabinoids that contain no more than 0.2% psychoactive cannabinoids.
The law lists CBD, CBG, CBC and CBDV as non-psychoactive, and THC as psychoactive. So in practice:
- Flower (buds) at or under 0.2% psychoactive cannabinoids falls outside the legal definition of cannabis.
- Flower above 0.2% is cannabis, and the stricter personal-use rules apply (see our guide to cannabis and CBD law in Malta).
- Anything containing HHC, HHC-O, HHC-P, H4-CBD, THC-P or similar is prohibited, whatever its THC level.
CBD hash, resin and pre-rolls
The same rules apply to hash, resin, pollen and pre-rolls. They are judged by what is in them, not by what they are called. There is one important difference: these products are concentrated or processed, so it is harder to tell what has been added to them just by looking.
That is why a lab report matters even more for hash and resin than for flower.
The HHC problem
Some products sold as “CBD flower” or “CBD hash” in Europe have been sprayed with semi-synthetic cannabinoids such as HHC to make them stronger. HHC was banned in Malta by Legal Notice 238 of 2024, and Act XII of 2025 lists it, and similar substances, as prohibited.
Warning signs:
- the name or label mentions HHC, H4-CBD, THC-P or another “new” cannabinoid;
- the seller promises a strong effect or a “high”;
- there is no lab report, or the report only shows CBD and THC and nothing else;
- the price or the effect seems too good to be true.
How to check a CBD flower or hash product
- Ask for the lab report (certificate of analysis) for the exact batch, from an independent lab.
- Check the THC line. Total psychoactive cannabinoids should be 0.2% or less.
- Look for a semi-synthetics screen. A good report shows HHC and similar substances were tested for and not found.
- Check the seller. A real address, a way to contact them, a returns policy and independent reviews.
- Keep it in its labelled packaging with the receipt and lab report. CBD flower looks and smells much like THC cannabis.
Why Dr. Hemp Me doesn’t sell flower
We have been making CBD products since 2018, and we have never sold flower, hash, resin or pre-rolls. Three reasons:
- You know exactly how much you’re taking. Our 10% oil has about 5mg of CBD in every drop. With flower, the amount varies from bud to bud and from batch to batch.
- Every batch is THC-free and tested. You can read the report for every product on our lab tests page before you buy.
- No smoke. Oils go under the tongue, gummies and capsules are swallowed. Nothing to light.
THC-free alternatives to CBD flower
- CBD Oil 10% | Calm (€49.95): the one most people start with.
- CBD Oil 10% | Sleep (€59.95): for your evening routine.
- CBD Oil 30% | Recovery (€119.95): our strongest, about 15mg a drop.
- CBD Gummies 750mg (€49.95) or CBD Capsules (€59.95): if you’d rather not use drops.

Frequently asked questions
Is CBD flower legal in Malta?
CBD flower made from non-psychoactive cannabinoids, with no more than 0.2% psychoactive cannabinoids such as THC, falls outside the legal definition of cannabis under Cap. 101 as amended by Act XII of 2025. Flower above that limit is cannabis, and products containing HHC or similar substances are banned.
Is CBD hash legal in Malta?
The same 0.2% rule applies to hash and resin. Because they are processed, ask for a batch lab report that also screens for HHC and other semi-synthetics.
Does Dr. Hemp Me sell CBD flower, hash or pre-rolls?
No. We make THC-free CBD oils, gummies, capsules, balm and cream, each tested by an independent lab, with free delivery across Malta and Gozo.
Can I get CBD flower delivered in Malta?
We don’t sell flower. If you buy it from someone else, check the batch lab report and the seller before you order. Our CBD oils, gummies and capsules are delivered free to any address in Malta and Gozo.
Is HHC legal in Malta?
No. HHC was banned by Legal Notice 238 of 2024, and Act XII of 2025 lists HHC, HHC-O, HHC-P, H4-CBD, THC-P and similar substances as prohibited.
